These terms apply to all purchases made with Forti Nova Ltd, whether online, by phone, or in person at our Blackburn trade counter. Please read them before placing an order.

General Terms
- Applicable Terms — These conditions apply to the present contract and all future contracts between Forti Nova Ltd ("the Company") and any purchaser. No inconsistent condition included in a purchaser's order shall apply unless expressly accepted by the Company in writing.
- Agreement to Terms — By placing an order with the Company — whether online, by phone, or in person at our Blackburn trade counter — the purchaser confirms they have read and agree to these Terms of Service and our Privacy Policy.
- Changes to Terms — The Company may update these terms at any time without prior notice. Changes apply to all subsequent orders. We recommend reviewing this page before placing an order.
- Technical Knowledge — The Company assumes the purchaser has the relevant knowledge of building regulations, product installation requirements, and health & safety obligations applicable to their project.
Pricing
- Published Prices — The price payable for goods is as displayed on our website at the time of order, plus any applicable delivery charges. The Company reserves the right to change prices without prior notice.
- Pricing Errors — If a product is incorrectly priced due to a website error, the Company is not obliged to supply goods at the incorrect price. We will contact you to confirm the correct price or cancel the order.
- Promotional Pricing — Prices in promotional materials or price lists may differ from website prices. The Company is under no obligation to honour prices that differ from those currently shown on the website. All price statements constitute an "invitation to treat" and not a binding offer.
- VAT — All prices are exclusive of VAT unless otherwise stated. VAT is charged at the prevailing UK rate. Forti Nova Ltd VAT No: 48 27215 80.
Payment
- Payment Before Dispatch — The Company must receive full payment for goods ordered — including any delivery charges — before an order can be processed.
- Accepted Payment Methods — We accept payment by debit or credit card, cash (in person at our Blackburn trade counter), and BACS bank transfer. BACS payments must be cleared before orders are dispatched.
- Payment Security — The Company takes all reasonable precautions to keep order and payment details secure. However, the Company cannot be held liable for losses arising from unauthorised access to information provided by the purchaser.
- Suspension of Deliveries — Failure to make payment on any order entitles the Company to delay, suspend or cancel further deliveries at its sole discretion.
Delivery
- Standard Delivery Timeframe — Most standard stock items are dispatched and delivered within 0–5 working days from order confirmation. Delivery times are estimates and not guaranteed unless agreed in writing.
- Light Gauge Steel (LGS) Frames — Light Gauge Steel structural frame systems are manufactured to order. Lead time is 0–6 weeks from order confirmation. The Company will provide an estimated delivery date at the time of order.
- Signature Required — A valid signature from a person aged 18 or over is required on delivery or collection. If your delivery is not received within the stated timeframe, contact us immediately.
- Check Before Installing — Do not begin any installation work until the complete order has been received and all goods checked for defects or missing parts. Time is not of the essence for delivery.
- UK Mainland Only — Delivery is available to mainland UK addresses only, unless special arrangements have been agreed in writing.
- Delivery Location — For health and safety reasons, most items are delivered to the exterior of a ground floor location. The purchaser is responsible for onward transport. The Company does not provide unpacking, installation or fitting services on delivery unless separately agreed.
- Failed Delivery — The purchaser must take all reasonable steps to enable delivery at the agreed date and location. If delivery fails due to the purchaser's actions, re-delivery costs will be borne by the purchaser. If re-delivery cannot be arranged, the Company may cancel the order and issue a refund less the failed delivery costs.
- Risk & Title — Goods pass to the purchaser's risk upon delivery. Title in the goods does not transfer to the purchaser until full payment has been received. Until that point, the purchaser holds the goods as bailee and must store them separately, clearly identified as the Company's property.
Availability & Product Changes
- Stock Availability — All items are subject to availability. If the Company is unable to supply goods, the purchaser will be informed promptly and a full refund issued.
- Product Specification — Under a policy of continuous improvement, or in the event of non-availability of components, the Company reserves the right to alter, change or amend product specifications without notice.
Cancellations & Returns
- Cancellation Window — The purchaser may cancel an order within 5 days of delivery or collection by notifying the Company in writing by email to info@fortinova.co.uk. If cancelling due to a fault with the goods, this must be stated at the time of cancellation.
- Restocking Fee — If goods are returned for any reason other than being faulty, incorrect, or an unsuitable substitution, a restocking charge of 20% of the goods value will be applied to the refund.
- Return Postage — Goods must be returned at the purchaser's cost unless the Company agrees to arrange collection. Where goods are being returned because they are faulty, incorrect or unsuitably substituted by the Company, return costs will be covered provided the Company nominates the carrier.
- Refunds on Unwanted Goods — A refund less the 20% restocking charge will be issued provided all other conditions are met and goods are returned unused, in original packaging and in resalable condition.
- Non-Returnable Items — The Company does not accept returns of bespoke or modified items, including cut materials, made-to-order LGS steel frame kits, or custom-cut membranes. Opened adhesives, primers or pastes cannot be returned.
- Faulty or Damaged Goods — If goods arrive damaged or are not as described, notify the Company by email within 48 hours of receipt with photographs. For confirmed faults, the Company will arrange collection and provide a full replacement or refund at no charge.
Exclusions & Warranty
- Voided Claims — Any claim is void if damage or failure arises from neglect, vandalism, subsidence, accident, misuse, acts of violence, environmental pollution, or uncharacteristic weather conditions.
- Warranty Claims Process — All warranty claims must be submitted to the Company in writing by email to info@fortinova.co.uk.
- Regulatory Compliance — The purchaser is responsible for ensuring that supply and installation of goods complies with all applicable statutes, regulations, and planning requirements, and that all necessary licences, permits and authorities have been obtained.
- Amendments — Any alteration to this agreement — including these terms — invalidates the agreement unless agreed in writing by the Company.
Liability
- Cap on Liability — The Company's total liability — whether in contract, tort or otherwise — shall not exceed the price paid by the purchaser for the goods giving rise to the claim. The Company shall not be liable for loss of profits, special damages, consequential loss, or interest charges.
- Statutory Rights — Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or the Sale of Goods Act 1979.
- UK Use Only — Goods are intended for use in the UK only. The Company cannot confirm compliance with laws or standards outside the UK. All goods are sold in accordance with the manufacturer's specifications.
- Trade Customer Indemnity — Trade customers agree to hold the Company harmless and indemnify the Company against any liability, claim or allegation arising from the installation or use of goods supplied by the Company.
Termination
- Right to Terminate — The Company may suspend supply, stop goods in transit, or terminate the contract verbally or in writing if the purchaser breaches any obligation under these terms, becomes unable to pay debts as they fall due, or if insolvency or bankruptcy proceedings are commenced.
- Effect of Termination — Upon termination, all outstanding sums owed to the Company become immediately due and payable, and the Company shall have no further obligation to supply goods.
Force Majeure
- Events Beyond Our Control — The Company shall have no liability for any failure or delay in supply or delivery, or for damage or defect to goods, caused by any event or circumstance beyond the Company's reasonable control — including but not limited to strikes, industrial disputes, extreme weather, supply chain disruption, or acts of God.
General Legal
- Severability — If any part of these conditions is found to be invalid, illegal or unenforceable, the validity and enforceability of all remaining conditions shall not be affected.
- Governing Law — This contract is governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Trademarks — All brand names, product names, service marks and copyright used on this website or in documentation are the property of their respective holders. No permission is granted by the Company for use of such marks by any third party.
- Copyright — All designs, text, graphics and their arrangement on the Company's website are copyright of Forti Nova Ltd. Users may print or copy pages for personal, non-commercial use only. Any other use without prior written consent is strictly prohibited.
Your Statutory Rights
Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 (consumers) or the Sale of Goods Act 1979 (business customers). If goods are not as described, not fit for purpose, or of unsatisfactory quality, you have the right to a repair, replacement or refund regardless of this policy.
